2. Scope and principles
This policy describes how we collect, use, store and protect your personal data. It is drafted in accordance with the General Data Protection Regulation (GDPR) and the ePrivacy Directive (EU), and includes references to and rights applicable under relevant U.S. law (for example, CCPA/CPRA) and international best practices.

3. Purposes of processing and legal basis
We process your data for the following purposes:

• To manage requests for quotes, appointments and commercial communications related to our services. (Legal basis: pre-contractual measures / consent).

• To manage service delivery, billing and accounting and tax obligations. (Legal basis: performance of a contract / legal obligation).

• To send commercial and marketing communications only when the data subject has given prior consent. (Legal basis: consent).

• Measurement and analysis of advertising campaign performance (Google Ads conversion tracking on buttons) to optimize campaigns. (Legal basis: consent for non-essential cookies/tracking; legitimate interest for anonymized analysis where it does not identify the person).

• Incident management and customer service. (Legal basis: performance of a contract / legitimate interest).

4. Data processed
We may process, as applicable, the following categories of data:

• Identifiers: full name.

• Contact: phone number, email address, postal address (if required for a service visit).

• Data about the pool or the requested service (features, photos provided by the customer).

• Technical data: IP address, browser type, device data and cookies (for the purposes described in the Cookie Policy).

We do not collect special category (sensitive) data except when voluntarily provided by the user (in which case they will be informed and, where applicable, give explicit consent).

5. Retention
Data will be retained:

• While a contractual relationship exists or until you withdraw consent.

• For accounting/tax purposes, for the legally required periods in the applicable jurisdiction.

6. Recipients and processors

Data may be disclosed to:

• Providers that provide technical or marketing services: Google (Google Ads / conversion measurement tools) as a processor.

• Other contracted providers for technical management, billing or customer service (each will be indicated and subject to a Data Processing Agreement).

• Public authorities when there is a legal obligation.

If we carry out international transfers (for example providers with servers in the U.S.), we will adopt appropriate safeguards (Standard Contractual Clauses or another valid mechanism), documenting and recording such transfers.

7. Data subject rights
You have the right to: access, rectify, erase, request restriction of processing, object to processing, request portability and withdraw consent where applicable. To exercise your rights, write to info@proqualitypools.com with the subject “Exercise of GDPR/CCPA rights” and include a copy of an identity document when necessary to verify identity.

If you are a California resident, you also have the right to: request information about categories and purposes of processing, access data collected in the last 12 months, request deletion of your data and opt out of the sale or sharing of your personal data. Pro Quality Pools does not “sell” personal data; if in the future any sharing arises that could be considered a “sale/sharing,” we will notify and provide opt-out options.

8. Response and verification procedure
Requests will be addressed within the legally applicable timeframe (normally 30 business days). For complex requests or those requiring additional verification, we will inform you of any extension or required steps.

9. Security
We have implemented reasonable technical and organizational measures (access controls, backups, internal access policies) to protect data. However, no system is infallible: in the event of a security breach affecting rights, we will follow applicable notification obligations (to supervisory authorities and, where appropriate, to affected individuals).

10. Minors
We do not collect personal data from children under 13 for commercial purposes. If we detect that we hold data of minors collected without required parental consent, we will delete it.

11. Changes to the policy
We may update this policy. The “Last updated” date will reflect the current version. We will notify material changes via a notice on the website or direct communication if changes significantly affect individuals’ rights.
